Details: AMCHAM has announced an event to be held on 18 November at 18:00 at the premises of Allen & Overy (33 Ave JF Kennedy, L-1855 Luxembourg-Kirchberg) for an update on the dismissal procedure for economic or performance reasons through recent case-law developments.
Although the Luxembourg rules are partially inspired by the law systems of our neighbouring countries, they are subject to particularities, which in addition evolve over time depending on case-law assessments. The result is that in practice, confusions and wrong assumptions are frequent.
The aim of this seminar is to eliminate those confusions and wrong assumptions by helping you better understand the approach of the Luxembourg labour courts in the dismissal procedure. Questions like the following will, for instance, be addressed:
- Is it true that economic dismissals are easier to put through than dismissals for underperformance?
- Is it true that in the event of a redundancy, I first need to try to re-assign the employee to another position?
- Is it true that I need to address the situation of the entire group when drafting the reasons for an economic dismissal?
- Is it true that only dismissals are counted for the thresholds regarding collective dismissals (social plans)?
- Is it true that the Luxembourg courts have rendered the dismissals for underperformance even more difficult to put through than in the past?
- Do I need to set up a performance improvement plan (PIP) before a dismissal for underperformance?
The experienced speakers will illustrate in their presentation numerous examples and practical tips.
