
On Wednesday 30 November 2016, the Cabinet of the Luxembourg Government adopted a preliminary draft law aimed at administrative simplification and the relieving of judicial proceedings in respect of radar-detected traffic offenses, resulting in a fine of €49 (without penalty points on the driver's license).
The changes envisaged in relation to the existing legislation are as follows:
• the owner of the infringing vehicle is to be informed of the infringement by sending a standard letter instead of a registered letter (80% of the people concerned pay their fine within the prescribed period and that it is unnecessary to oblige them to go to a post office);
• if the fine is not paid within the time limit (45 days), a registered letter is to be addressed in a second step to the recipients who have not paid the fine or who have disputed the offense;
• in the event of non-payment of the fine within the time limit (45 days) by the second (registered) letter, the present procedure consisting of the drawing up of a report shall be replaced by a flat-rate tax, the amount corresponding to the amount of the fine plus additional administrative costs estimated at €26;
• Failure to pay the flat-rate tax within 45 days will be recovered by the Administration des douanes et accises (Customs Administration). In addition, the Grand Ducal Police and the Customs Administration have the option of immobilising the vehicle.
