
As part of Luxembourg's Presidency of the Committee of Ministers of the Council of Europe, an event titled "Better enforcement of national judicial decisions: a requirement for human rights and the rule of law" took place on Monday 17 March 2025 in Strasbourg, France.
In a press release, Luxembourg’s Ministry of Justice reported that the event was jointly organised by the Council of Europe, represented by its Director General of Human Rights and the Rule of Law, Gianluca Esposito, and the Luxembourg Ministry of Justice, represented by Minister Elisabeth Margue.
Minister Margue delivered the welcome address at the conference, on the principles, challenges and possible solutions for better enforcement of national judicial decisions. She emphasised the importance of a fair trial guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms and the enforcement of national court decisions as an integral part of the latter.
The objective of the conference was reported as both to explore the main issues surrounding this non-enforcement of national court decisions in light of recent case law of the European Court of Human Rights and also to examine existing best practices to enable the implementation of appropriate enforcement procedures.
Minister Margue had recently advocated in Strasbourg for the effective application of the European Convention for the Protection of Human Rights and Fundamental Freedoms through a broader access to knowledge of Strasbourg case law to national courts, the primary guardians of human rights protection.
The common thread running through the two conferences was the enforcement of court decisions as a pillar of the rule of law and access to justice.
