The Luxembourg Army has issued a statement reacting to rumours earlier this month concerning reported inappropriate behaviour by a training NCO with regard to two recruits; the statement acknowledges that the allegations were immediately investigated with the female staff concerned who are currently pursuing their basic training.
On 17 June 2015, the military prosecutor, a magistrate commissioned officer, received the facts. Responsible for the prosecution and the investigation of criminal cases concerning the military personnel, the military prosecutor concluded that the facts known to date would not be likely to constitute a criminal offense and forwarded the dossier to the Army Staff to enable it to exercise its disciplinary powers if necessary. The same day the Army Staff triggered disciplinary proceedings against the training NCO concerned.
Before imposing appropriate disciplinary punishment by reasoned decision, the issue was recorded on 18 June 2015, with a written position expected by 29 June 2015 at the latest.
If the disciplinary investigation reveals other facts that may constitute a criminal offense, the facts will be reported to the relevant public prosecutor.
As a precaution, on 18 June 2015, the training NCO was suspended until further notice, of having any direct or indirect contact without the presence of others, with female trainees soldiers currently pursuing their basic training.
Accused of indecent assault on a member of military personnel when on a mission abroad in 2011, the training NCO received - pending appeal - a suspension of pronouncement of the judgment for the period of 5 years. Suspended until September 2011, he was assigned thereafter for 7 months to the Army Staff headquarters. He joined the Army in Diekirch in April 2012. By July 2013, he was part of "unités de disponibilité opérationnelle" (UDO) and then participated in a peacekeeping operation. In January 2015 he became an instructor at the IB (instruction de base ).
