From today, Thursday 16 September 2021, a series of procedural changes aimed at making Luxembourg's justice system more efficient will come into force.

With the law of 15 July 2021, Luxembourg's Ministry of Justice carried out a major reform of the New Code of Civil Procedure with the aim of strengthening the efficiency of civil and commercial justice.

From 16 September 2021, exactly 23 years after the entry into force of the New Code of Civil Procedure, a series of procedural changes will come into force in order to facilitate the litigant's access to justice and to guarantee him an efficient procedure taking place within a reasonable deadline.

The law of 15 July 2021 notably introduces the following changes:

  • increase in the competence rate for justices of the peace from €10,000 to €15,000;
  • a single appeal procedure for judgments rendered by justices of the peace in civil and commercial matters;
  • improving efficiency and simplifying the conditional payment order procedure;
  • creation of a simplified procedure for less complex cases between two parties whose value of the dispute is between €15,000 and €100,000;
  • obligation for lawyers to draw up summary conclusions before the end of the investigation.

Other changes include the introduction of a procedure making it possible to obtain the rectification of a material error or the interpretation of a judicial decision, the strengthening of the powers of the judge within the framework of the procedure of the state and the creation of an optional procedure allowing litigants to know before the launch of an appeal procedure whether their intermediate judgment is appealable or not.
