On Monday 10 October 2022, Luxembourg's Ministry of the Environment, Climate and Sustainable Development and the Ministry of Energy and Spatial Planning announced that Luxembourg will join Austria in an appeal against the EU "taxonomy" delegated act.
The "taxonomy" delegated regulation which includes nuclear energy and natural gas in the "green taxonomy" was published in the Official Journal of the European Union (OJEU) on 15 July 2022.
Austria has lodged an appeal against the "taxonomy" delegated regulation on 7 October 2022. Luxembourg will intervene alongside Austria according to the Intervention article 40 Protocol (No 3) on the statute of the Court of Justice of European Union.
After publication of the notice relating to the action brought by Austria in the OJEU, Luxembourg will submit its request for intervention before the European courts. After the admission of this request, Luxembourg may file its statement in intervention with the European courts. This statement in intervention will contain the argument on the merits against the “taxonomy” delegated regulation.
